Alternative Dispute Resolution

As a natural result of increased interaction and communication, disputes have begun to differ in nature. Although disputes were traditionally resolved through state litigation, in today’s world, alternative dispute resolution methods have emerged due to the inability of state litigation to protect the interests of the parties in terms of cost, duration, and quality. The importance of alternative dispute resolution methods continues to grow.

Mediation provides a faster, more efficient, more economical, and confidentiality-based solution compared to the outcome sought in litigation. Mediation gives parties the right to choose a neutral, trustworthy, and specialized individual as a mediator with mutual consent. The mediator does not aim to determine right or wrong but rather strives to find an agreement that balances the interests of both parties in the most suitable manner. Mediation, which has gained significant importance in both world and Turkish law, is increasingly becoming a key solution path. Mediation is divided into two types:


  • Compulsory Mediation: In our legal system, except for disputes arising from labor law and commercial lawsuits, compulsory mediation has been introduced as a requirement before filing lawsuits. If mediation is not pursued before filing a lawsuit, the lawsuit will be dismissed for lack of the required condition.

  • Voluntary Mediation: All private law disputes, businesses, and lawsuits that the parties can freely dispose of can be resolved under the Mediation Law. There is no time limit for applying for voluntary mediation, so it can be applied both before and during the lawsuit process.

The mediation process, whether compulsory or voluntary, is concluded by either reaching an agreement or preparing a report in case of no agreement. If an agreement is reached, the agreement document can be made enforceable by obtaining a decree from the competent and authorized court.
